People arrested on county matters are generally routed to the state-operated Tygart Valley Regional Jail and Correctional Facility in Randolph County.

This division of authority matters. The sheriff may be able to document when its deputy delivered a person into regional-jail custody. WVDCR controls the later facility movement and physical departure record. A court supplies the signed order or judgment that explains the legal basis. If the question is “Did the sheriff arrest or transfer this person?” the sheriff is a logical custodian. If the question is “When did the person leave Tygart Valley, and where did the person go?” ask WVDCR or the facility.

Geography can mislead a Preston search. Tygart Valley sits outside the county, while the federal Hazelton complex is physically inside Preston. USP Hazelton and FCI Hazelton are BOP institutions, not the jail for ordinary county arrests. A federal locator result should not be merged with a sheriff arrest or WVDCR movement merely because both mention Preston County. Start with the arresting or sentencing authority, then match date of birth, case number, booking or agency identifier, and facility. This custody-type check keeps state regional-jail, state-prison, and federal records in their proper systems.

Request Preston Sheriff Arrest Records

West Virginia FOIA §29B-1-3 directs requests to the custodian and requires a response as soon as practicable, within five days excluding weekends and legal holidays. Preston Sheriff Release Limits

This is not a reason to substitute an unofficial app. It reflects the regional system: WVDCR operates the serving jail and publishes the state jail search.

The WVDCR Daily Incarcerations page is not a release archive. A person missing from a current search may have entered prison custody or another agency's custody. Confirm the endpoint.

Recent-event timestamps also describe different acts. A sheriff report may show when a deputy transferred the person. A court docket may show when an order was entered. WVDCR may record physical departure after staff check warrants, detainers, and the receiving agency. VINE may report the source-system change later, and WVDCR says a transfer call follows arrival rather than movement. State the source beside each time. “Release authorized” fits a court order alone, while “released to the community” requires facility evidence supporting that destination.

Preston Sheriff Photo Requests

The sheriff may hold a photograph it created or received during an arrest. Request the specific arrest or booking photograph tied to a named incident. Tygart Valley is more likely to hold the regional-jail booking photograph. A photo proves neither guilt nor later release, and a prison intake photo may differ from the county arrest image.

West Virginia Code §62-1-6a addresses social-media posting and removal for certain booking photographs held by covered law-enforcement agencies. It is not a blanket public-record rule. The statute also excludes WVDCR and its subordinate entities from its covered agency definition. Therefore, do not assume the same treatment for a WVDCR offender photograph. If a request is denied, ask which agency is the custodian, what specific exemption applies, and whether segregable portions can be released.

If staff identify Tygart Valley as the receiving facility, move the release inquiry to WVDCR. That route respects who created each record and reduces avoidable referrals.

No standard fee was verified, but West Virginia FOIA limits reproduction charges to costs reasonably tied to actual reproduction and does not allow search, retrieval, or staff time to be charged as reproduction cost. Request an existing electronic copy in electronic form. If part of a report contains protected investigative, personal, or confidential material, ask for segregable nonexempt fields and the exact legal basis for each withholding.

Confirm Preston Regional Jail Release

For an arrest last associated with Preston, search the WVDCR jail system first. A live Tygart Valley result supports current regional-jail custody. If no result appears, search the WVDCR prison system for a state commitment. Then check West Virginia VINE and the correct Preston court. Preston Sheriff and Court Records

Sheriff and court records serve different roles. An arrest report describes law-enforcement action. Magistrate court often holds the early charge and bond chronology. Circuit court holds felony disposition, sentencing, modification, probation, and expungement records. A court order can authorize a custody change but does not prove that facility staff completed the physical release at the same time.

Use the same identifiers across sources: full name, date of birth where lawfully public, case number, WVDCR OID or booking number, facility, and event date. Do not join records on name alone. Preserve the search date because custody data can change. When sources disagree, report what each shows and obtain the corrected official record. The agency that created the event record remains the best source for that event.

Keep a source log for a recent event. Record when the sheriff report was requested, when the court order was entered, when the WVDCR search was checked, and which agency supplied the final destination. A time in an arrest report may describe deputy action rather than WVDCR intake. The order time may precede departure. VINE may follow the source-system update.
