An ICE detainer can affect what happens when criminal custody would otherwise end. If WVDCR says a person was “released to ICE,” the wording describes interagency transfer. The person did not necessarily enter the community. Ask WVDCR for the physical departure time, receiving agency, destination, and detainer disposition, then confirm the intake through ICE.
ICE custody is civil immigration detention. It is separate from a Preston criminal case, WVDCR prison custody, BOP sentenced custody, and USMS federal pretrial detention. Each system has its own record. The end of ICE detention also does not automatically resolve every criminal court, supervision, or other agency obligation.

The biographical route uses exact name, country of birth, and date of birth. Enter the information as the agency record would show it and check reasonable name forms when needed.

The public locator has limits. Official guidance has described current detainees and some people recently released within an approximate period. Minors are excluded. A no-result can reflect spelling, scope, update delay, age, or elapsed time and is not conclusive.

Identity errors are especially easy across jail, federal, and immigration records. Do not search by a shortened name and then assume the first result belongs to the intended person. Obtain the A-number from an official document when possible and retain leading zeros needed for the nine-digit format.

For a formal record, identify the person, A-number if known, sending agency, transfer date, and narrow event sought. Ask for the existing intake, transfer, release, or destination record rather than asking ICE to create a custody analysis. Follow the current official records process shown by the agency.
ICE Detainers and Transfers
The official ICE detainer information page explains the agency's detainer role. For release research, the critical fact is operational: a criminal custodian may end its hold and deliver the person to ICE. Request the sending agency's detainer disposition and receiving-agency field.
A court dismissal, completed county sentence, or BOP release does not defeat a separate ICE action by itself. Conversely, an ICE locator release concerns ICE detention. It does not prove the end of a state case, federal supervised release, or another warrant. Keep each event attached to its agency and time.
No Preston ICE Facility
The research found no ICE-dedicated detention facility or verified county ICE detention contract in Preston County. ICE belongs in the facility list as a conditional destination system, not as a local jail building. Do not publish an address, pickup point, visiting schedule, or release counter for a Preston ICE site that official sources do not identify.
If a record names a particular ICE detention location, use the location and contact route in the live ICE result or official detention resources. A person can be moved after intake, so confirm the current location before travel or document delivery. An ICE result showing release marks the end of the detention reported by ICE. It may mean release into the community, removal, transfer, or another outcome that must be confirmed from the available agency record. Do not infer the destination from the word “released” alone.
Preserve the exact result, query date, A-number, and identity details. Check the immigration case record or official contact route when the legal posture matters. If a state, local, or federal authority receives the person, follow that system next. A complete timeline can contain several valid release events because each agency reports only its own custody.
Resolve an ICE No-Result
A blank ICE locator result should trigger a source check, not a release conclusion. First verify the A-number and its digits from an official document. Confirm the country of birth and the spelling order used for family and given names. If the biographical route was used, check the date of birth and reasonable name forms. Record the exact query and time so later updates can be compared.
Next, return to the sending agency. A WVDCR, BOP, or USMS record should identify when its custody ended and, when available, the receiving agency or destination. Ask whether the transfer was completed or merely planned. An ICE detainer in a file does not by itself prove that ICE accepted custody. The intake side is established through ICE, while the departure side remains with the sending agency.
Public scope can also explain silence. ICE guidance excludes minors from the public locator and describes a limited recent-release reach. Data may lag a movement, and a person may have left the window shown to the public. Call the Detention Reporting and Information Line with the identifying information permitted by the official process. Verify its current posted hours before calling because operational schedules can change.
If ICE confirms a later release, ask what record describes the disposition when that fact matters. The end of civil immigration detention is its own event. It does not rewrite the earlier criminal release, BOP event, or court supervision. Maintain separate timestamps for WVDCR or federal departure, ICE intake, ICE movement, and ICE release. That sequence prevents a no-result from erasing an agency handoff that official records can still document.
Read ICE Release Evidence
An ICE release result is a statement about ICE detention. Capture the exact wording, result date if shown, A-number, and query time. Do not change it into a claim about the earlier Preston case. The criminal custodian's departure happened in a separate system and may have preceded ICE intake. Both records are needed to show the handoff.
The destination after ICE custody may not be apparent from the public locator. Use the official information route or the relevant immigration record when the disposition matters. Possible custody outcomes should not be guessed. Describe only what ICE reports and follow a named receiving authority. A result that no longer appears can reflect the locator's recent-release scope rather than a reversal of the event.
